In DS9's "Inquisition", Sloan explains that Section 31 has been around since the inception of the Federation, and that they were officially part of the original Federation Charter. Because Enterprise takes place before the foundation of the Federation, Section 31 should not exist yet. However, it is implied in this episode (and the last one) that they have already been in operation for years by this point. Harris also tells Archer what part of the Starfleet Charter allows them to operate.

   
Regarding an explanation to the engine techno problem: Perhaps they could shut down the engine for a short time and allow the pressure to build up before a breach. If they kept the speed a few notches above the red line, they might have created a nice cushion of a couple of minutes of pressure they could withstand. The flip side to this is they'd have to power up at about the same speed they were at before the engine was shut down, or else the pressure buildup would cause a breach at the lower speed, kind of like the transmission dropping out of a car if you shift gears the wrong way. That's why they had to stay in the Columbia's warp bubble and couldn't slow down until after they powered up the engines. And letting the fuel run out might not have been an option because the strutural integrity couldn't hold out as long as it would have taken (even if they dumped excess fuel pods?!?).
   
As Trip prepares to board Enterprise from Columbia, he is shown wearing a bronze Starfleet EVA suit. However, if you look closely at Trip's left side, you can see that the suit bears the Enterprise mission patch and not Columbia's.
   
While on Enterprise, Trip's uniform has his Enterprise mission patch despite him picking up the Columbia patch in the previous episode
